BMW South Africa and my failing X3

Now that the legal mumbo jumbo and of course legal disclaimer (link at the bottom of the page) are out of the way we can get to the nitty gritty and reason for this website.
BMW have stated that my use of the vehicle is outside of the operating parameters of the vehicle.
The vehicle is apparently operating within BMW's technical specifications.
BMW have recommended a X3 2.0D automatic to solve the problem but it would cost me a substantial amount of money to do that.

Why do I need to have this site
Before you say 'Get off your soap box' understand that I have followed all diplomatic means and approaches on this.
There are only a few issues I can't handle:
1. Corporates that take advantage and don't stand by their commitments.
2. Paying for a service and not getting it.
3. Paying R 410,000 for a 4x4 SUV that can't reverse up my own driveway.
